Part A of this Privacy Policy is published in accordance with the provisions of the Indian Information Technology Act, 2000 (“IT Act”) and the rules made thereunder, more specifically, The Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011 and the Information Technology (Intermediary Guidelines) Rules, 2011. All terms used in this Privacy Policy will have the same meaning and definitions assigned to them in the IT Act and the Rules made thereunder.

Additionally, if you are a natural person based in the European Economic Area, the provisions of Part B of this Privacy Policy will apply to how we process your personal information. Part B of the Privacy Policy is published in accordance with, and in compliance of, the provisions of the European Union General Data Protection Regulation (“GDPR”).

PART ‘A’

This includes Personal Information (“PI”) and Sensitive Personal Data and Information (“SPDI”) defined under the IT Act. Depending on the type of communication or transaction, the personal information we collect may include, but is not limited to, your name, postal address, date of birth, PIN code, telephone numbers, mobile phone numbers, your organization’s name, email addresses, credit/debit card information, bank information or billing information.

1.2. We collect this information from you to extend services like processing of your donations, providing receipts and tax exemption certificates, sending regular updates about the work we do, respond to your queries, announcing calls for volunteers and informing you about upcoming performances and events. We only collect PI and SPDI from you that we consider necessary for achieving this purpose and providing our services. In general, you can browse the Website without providing us with information regarding who you are or without revealing any PI about yourself.

1.3. We seek your personal information when you make a donation, request a communication or performance event from us, register for a workshop, pledge support to our work and campaigns and apply for working or volunteering with the Kattaikkuttu Sangam. This information may be sought over the phone, through the website, via email or by means of face-to-face interaction.

1.4. If you choose to donate or contribute on, or through, the Website, we might collect information about your donation patterns and generally your usage behavior.

1.5. If you send us personal correspondence, such as e-mails or letters, or if other users or third parties send us correspondence about you and your activities or postings on the Website, we may collect such information into a file specific to you.

2. Use of Your Information

2.1. We use your information -- if you have agreed to it -- to make sure you are receiving the most appropriate and relevant information for you, find out more about you and the people who are visiting our website, donating or joining our campaign, make sure we have an accurate record of all the donations we receive, and email you with news and information about us, our vision, mission, organizational changes, performances, events and our campaigns.

2.2. We may also use your personal information to resolve disputes, troubleshoot problems, help promote a safe service, collect money either directly by us or through an authorized payment gateway facility, inform you about updates, customize your experience, detect and protect us against error, fraud and other criminal activity, and enforce our terms and conditions.

2.3. In our efforts to achieve our vision, mission and goals and our service offerings, we collect and analyze demographic and user data about our users' activity on our Website. We identify and use your IP address to help diagnose problems with our server, and to administer our Website. Your IP address is also used to help identify you and to gather broad demographic information related to you.

3. Disclosing your personal information

3.1. By providing us with your PI and SPDI, you consent to the information being shared with our group companies or third-party service providers, where it is in our legitimate interest to do so for administrative or operational purposes.

3.2. We will not share your SPDI, i.e., your password, financial information such as bank account or credit card or debit card or other payment instrument details, that is not essential for your continued use of the Website, nor will details, that we share information about your sexual orientation, social background (including caste), educational background and financial status with any third parties or disclose to it to any person other than as required by applicable law.

3.3. We avail the services of third parties to provide donation facilities by means of cheque, credit/debit card payments or electronic fund transfers. While your information may be shared with these third parties, we make stringent efforts to require all third-party service-providers to hold personal information in strict confidence.

3.4. Any third parties we share your information with are limited by law and contract in their ability to use your PI for any purpose, other than to provide services for us. We will always ensure that third parties with whom we share information about our users are subject to privacy and security obligations consistent with this privacy policy and applicable law.

3.5. We may disclose your PI or SPDI, if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to respond to summons, court orders, or any other legal process. We may disclose your PI to law enforcement offices, third party rights owners, or others as becomes necessary, in the good faith belief that such disclosure is reasonably necessary to: (i) enforce our Privacy Policy; or (ii) protect the rights, property or personal safety of our users or the general public.

3.6. We use MailChimp for our newsletters and other announcements. The MailChimp’s mailing list uses your name and email address to send out these communications.

4. Storing your information

4.1. We keep your PI and SPDI for no longer than is necessary for the purposes that your PI/SPDI was collected and processed. The length of time for which we retain your PI or SPDI depends on the purpose for which we collect and use it, and/or as is required to comply with applicable law.

5. Links to Other Sites

5.1. Our Website may include links to other websites that may collect personally identifiable information about you. Such other websites are not operated by Kattaikkuttu Sangam and are only provided for your convenience. The links available do not imply Kattaikkuttu Sangam’s endorsement of activities of such third-party websites or Kattaikkuttu Sangam’s association with its operators. This Privacy Policy applies only to PI or SPDI collected, or PI received from third party sources. We are not responsible for PI about you that is collected and stored by third parties.

6. Changes to our Privacy Policy

6.1. As and when the need arises, Kattaikkuttu Sangam may alter its privacy practices in accordance with the latest technology, trends or changes in the Indian or international law. We strive to provide you with timely notice of these changes. You may reach out to us if you have any queries about any changes made to our practices.

7.1. By using the Website and/or by providing your information, you consent to the collection and use of the information you disclose on the Website in accordance with this Privacy Policy, including but not limited to your consent for sharing your information as per this privacy policy.

9. Governing Law and Jurisdiction

9.1. This Privacy Policy is governed by laws prevailing in India.  

9.2. Only the courts in Kanchipuram, Tamil Nadu, India will have jurisdiction with regard to disputes arising from this Privacy Policy.

10. Additional provisions applicable to EU residents only

10.1. The terms and conditions contained herein are only applicable to users of the Website located and residing in the EU. This section is not applicable to Kattaikkuttu Sangam’s users located and residing in India or other jurisdictions. 

10.2. We consider that the legal basis for using your personal information, after you have provided your consent, as set out in this Privacy Policy is as follows:

(i) Our use of your personal information is necessary to perform our obligations under any contract with you; or

(ii) Our use of your personal information is necessary to comply with our legal obligations.

10.6. Your personal information is used, stored and accessed by staff operating and servers located outside the European Economic Area. We may share personal information with our group entities and with third parties in accordance with the GDPR. Appropriate measures will be taken to ensure your PI is protected adequately in accordance with this Privacy Policy.
